Terms and Conditions
doubleUP wake + surf Murten – Version 25.04.2019
This document is a translation of the original German version. In case of discrepancies, the German version shall prevail.
By using sports equipment and participating in activities related to the offerings of the doubleUP club, hereinafter referred to as the operator, the guest or club member, hereinafter referred to as the customer, acknowledges the following terms and conditions.
Safety
Art. 1 Health
The customer confirms that they are in good health and meet the necessary physical requirements for water sports, particularly swimming ability. The customer also confirms that they are free from heart and circulatory disorders as well as severe orthopedic conditions. The customer is responsible for self-assessment and realistic evaluation of their physical well-being.
Art. 2 Minimum Age
The minimum age for participation in doubleUP activities is 8 years when accompanied by parents and 14 years without accompaniment. For underage customers, participation requires the consent of a legal representative. The legal representative confirms that the minor meets the necessary health and physical requirements. The legal representative is fully liable for any damages to persons, the boat, and equipment caused by the minor’s intentional or negligent misconduct.
Art. 3 Safety Equipment
For safety reasons, all sports equipment may only be used with a life jacket or a wakeboard/wakesurf vest.
Art. 4 Instructions from the Boat Operator
The instructions of the boat operator must always be followed.
Liability
Art. 5 Liability is the Responsibility of the Participant
The execution of water sports activities and the use of sports equipment are at the customer's own risk. Water sports activities involve unavoidable risks. By making a booking, the customer acknowledges that they are aware of the risks associated with water sports. If the customer wishes to receive more detailed information about these risks, they should consult the boat operator before engaging in the activity.
Art. 6 Personal and Property Damage
The operator is only liable for personal and property damage in cases of intent or gross negligence. In all other cases, the customer cannot make any claims against the operator. The operator assumes no liability for valuables and personal equipment, such as customer materials, that are deposited, stored, or kept on the premises. It is advisable to take out appropriate insurance for personal belongings and/or accidents.
Art. 7 Damage to Rental Equipment and Boats
The customer is responsible for maintaining rental equipment in proper condition and returning it undamaged. In cases of intentional or negligent damage or loss, the customer must cover the cost of repair or replacement. The customer is also liable for any damages to the boat caused by their negligence.
Costs
Art. 8 Prices
All prices are in Swiss francs. Sessions, events, and booked services are charged directly after they have been provided. Refunds in cash are not possible. The operator reserves the right to invoice part or all of the costs in advance for certain offers.
Art. 9 Cancellations and Withdrawal from Booked Services
Booked sessions and corporate events can be canceled by email up to 24 hours in advance. For cancellations within 24 hours, a cancellation fee of CHF 50.00 for sessions and CHF 200.00 for corporate events will be charged. The operator reserves the right to cancel a session at short notice due to weather or technical boat issues. In such cases, any pre-paid fees will be refunded.
Operations
Art. 10 Minute Packages
Minute packages cannot be transferred to other individuals. However, they can be shared within the family package or minute sharing program if this is noted with the operator. Unused minutes can be carried over to the next season, provided the membership fee has been paid by April 30. Otherwise, any remaining minutes will expire.
Art. 11 Smoking Ban
Smoking is strictly prohibited on the boat and the dock.
Data Protection
Art. 12 Personal Information
Customer data is treated confidentially and will not be shared with third parties. The email addresses of members and guests are used for sending newsletters. The newsletter can be unsubscribed from by emailing: welcome@double.ch.
Art. 13 Photo and Video Recordings
Photos and videos taken during a session or event by a person engaged by doubleUP may be used by doubleUP on its website and social media platforms, such as Facebook, Instagram, and Google+.
Legal Matters
Art. 14 Jurisdiction
Swiss law applies, even if bookings are made from abroad or the customer resides abroad. The place of jurisdiction for all claims related to doubleUP is Murten.
